Terms of use
These terms govern the use of the Pellizz app and the pellizz.app website, published by Hexalgo SAS. By using Pellizz, you accept them.
1. The service
Pellizz lets you create events, invite participants with a QR code, share photos in a private gallery and run photo challenges with a leaderboard. The free plan is limited (number of participants, photo quality, retention period); the current limits are shown in the app.
2. Account and minimum age
You can take part with just a first name (guest account); creating an event requires a full account with a verified e-mail address. An unsecured guest account is lost if the app is uninstalled. You are responsible for keeping your credentials confidential.
Pellizz is reserved for people aged 13 and over. Between 13 and 15, using it requires the permission of a person with parental authority: in France, a minor can only consent alone to the processing of their data by an online service from the age of 15 (GDPR article 8 and article 45 of the French Data Protection Act); before that age, consent is given jointly by the minor and that person. A child under 13 cannot use Pellizz, but may appear in a photo taken by an adult, under that adult's responsibility.
3. Your content
You remain the owner of the photos you send. For the event's retention period only, you grant the publisher the right to store them, resize them, show them to the event's participants and include them in the export requested by the organizers. Organizers and participants can download the event's photos.
You agree to only send photos you have the right to share, to respect the image rights of the people photographed (remove a photo if someone asks you to), and not to post any illegal, violent, hateful or pornographic content, content invading privacy or involving minors inappropriately.
4. Photos of minors
Only send a photo showing a minor with the permission of their parents (or a person with parental authority). Any parent can ask for a photo of their child to be removed: from the app, with the reason "My child / a minor is in the photo" (the report is sent to the organizers and to the publisher), or by writing to hello@pellizz.app. The photo is then removed quickly.
Any content involving minors inappropriately is strictly forbidden: it is deleted, its author's account is suspended or deleted, and the facts are reported to the competent authorities.
5. Moderation, reports and blocking
Every participant can report a photo; from 3 reports, it is hidden automatically until the organizers decide. Organizers can hide, restore or delete any photo of their event and remove a participant.
You can also report a photo to the publisher: from the app ("Also report to Pellizz" option, for illegal or serious content) or by writing to hello@pellizz.app with the event and the photo. The publisher handles reports within 24 hours; it may remove content, and suspend or delete an account in case of a breach of these terms.
You can block a user: their photos are no longer shown to you and you no longer get notifications triggered by their actions. They are not told.
6. Organizers' role
The organizer is responsible for their event: who they give the code to, the information entered (event name, tables, guest list) and moderation. They inform the people on their guest list that their name is used in Pellizz and remove from the list anyone who asks.
The owner of an event can transfer its ownership at any time to another participant with a full account; they then become a co-organizer. Before deleting their account, they transfer or delete each of their events.
7. Retention and deletion
An event is archived 30 days after its date, then permanently deleted, with its photos, at the end of its plan's retention period (90 days after its date on the free plan, 365 days on the Premium plan). Organizers get an e-mail reminder 7 days before the deletion: remember to request the ZIP export of the photos before that date. You can delete your account at any time, keeping your photos in the galleries or not (see Delete my account). Guest accounts without activity and accounts inactive for 3 years are deleted automatically, as described in the privacy policy.
8. Professional use: data processing addendum (GDPR article 28)
When an event is organized in a professional context (seminar, team building, company event), this addendum applies between the organizing company, the controller, and Hexalgo SAS, the processor. It is accepted by the person who creates or manages the event on behalf of the company.
- Subject matter: hosting and displaying the event's guest list and photos, letting participants join it, share their photos and take up challenges, producing the photo export.
- Duration: that of the event, until it is deleted by an organizer or automatically at the end of the plan's retention period.
- Data and data subjects: guest list names, photos and capture times, participation and challenge results, participants' accounts (display name, e-mail address where applicable); the data subjects are the event's guests and participants.
- Instructions: the processor only processes this data to provide the service described in these terms, according to the settings chosen by the organizers, and makes no other use of it (no advertising, no resale).
- Confidentiality and security: the people authorized to process the data are bound by confidentiality; security measures are described in the privacy policy (encrypted traffic, private storage, temporary links, limited backups).
- Sub-processors: those listed in the privacy policy, which the company authorizes, including transfers outside the European Union safeguarded as described in that policy. Any change is announced by updating the policy; the company can object by writing to privacy@pellizz.app.
- Assistance: the processor helps the company answer requests from data subjects exercising their rights and, where needed, with its impact assessments and its dealings with the supervisory authority.
- Data breaches: the processor informs the company without undue delay after becoming aware of a breach, with the relevant information.
- End of processing: the data is deleted at the end of the retention period (or earlier at an organizer's request), then erased from backups and file versions within 30 days; the company can retrieve the photos beforehand with the ZIP export.
- Audits: the processor provides the information needed to demonstrate compliance with these obligations and allows audits by the company or an auditor it appoints, with reasonable notice.
This addendum is also available on request, as a separate document, at privacy@pellizz.app.
9. Availability and liability
We do our best to keep the service available and reliable, without being able to guarantee it at all times (maintenance, network outages). Photos are kept on redundant storage, but Pellizz is not an archiving service: keep a copy of important photos with the export. The publisher is not liable for content posted by users, subject to its obligations once illegal content has been reported.
10. Changes, governing law, mediation and contact
These terms may change; the version in force is the one published on this page. They are governed by French law.
In case of a dispute, please write to us first at hello@pellizz.app. Failing an amicable settlement, the French courts have jurisdiction, without prejudice to the mandatory rules of your country of residence.
